/ Finally got around to reading the Articles of Impeachment that #TulsiGabbard voted “Present” on.  https://judiciary.house.gov/sites/democrats.judiciary.house.gov/files/documents/Articles%20of%20Impeachment.pdf …

/ The articles allege that Trump obstructed congress by not complying with subpoenas. Defying a subpoena is actually described in law as an act of contempt of congress, and one of the ways one could illegally obstruct congress.  https://www.everycrsreport.com/reports/RL34304.html …

/ Act of January 24, 1857, Ch. 19, sec. 1, 11 Stat. 155. made contempt of congress a crime. Problem in Trump’s favor tho… presidents are immune from charges of contempt of congress. This executive privilege exemption has protected many presidencies.  https://www.justice.gov/sites/default/files/olc/opinions/1984/05/31/op-olc-v008-p0101_0.pdf …

/ Congress really could have sued the White House to get the documents they wanted. They did this with Obama. Why didn’t they pursue that path? The second article of impeachment, in my opinion, is not an impeachable offense.

/ As far as the first article… Abuse of Power. Abuse of Power is not a crime. It’s a matter of ethics. Why didn’t they charge him with bribery instead of abuse of power? I’m looking at this, and I really don’t think they proved an act of bribery.

/ But his shenanigans do show a failure to uphold his oath of office. Still… that is neither a crime, nor an impeachable offense. Congress failed to prove that Trump committed an impeachable offense (treason, bribery, high crime or misdemeanor).

/ These articles of impeachment are a joke. Furthermore – it’s not even a legitimate impeachment until the articles are submitted to the Senate.  https://www.bloomberg.com/opinion/articles/2019-12-19/trump-impeachment-delay-could-be-serious-problem-for-democrats …

/ And I’m really not finding an acceptable reason to withhold the articles from the Senate.  https://www.msn.com/en-us/news/politics/tulsi-gabbard-criticizes-nancy-pelosi-for-suggesting-delay-in-sending-articles-to-senate-you-cant-make-up-the-rules-as-you-go-along/ar-BBYaZMC …

/ Tulsi Gabbard is right. This impeachment process is heavily flawed. The Democratic Party is making a mockery of our system.  https://www.realclearpolitics.com/video/2019/12/28/gabbard_i_voted_present_for_impeachment_because_the_entire_process_was_flawed.html …

/ Her censure resolution holds more weight against Trump than their fake articles of impeachment.

/ Her censure resolution also indirectly condemns congress for shirking their duties. Everything on her list could have been dealt with appropriately with legislation. Legislation that Tulsi wrote, but which her colleagues have refused to support. Despicable.

/ Read this again. Tulsi has accused Trump of war crimes. And by letting him get away with it all, congress is complicit.

/ FYI: Presidents are exempt from laws related to violating oaths of office.  https://www.law.cornell.edu/uscode/text/5/3331 …

/ We’ve been here before. If you can tolerate the archaic language, here’s some food for thought: Winthrop’s Little Speech.  https://constitution.org/bcp/winthlib.htm …

/ The danger in all this: If Dems don’t let this proceed to the Senate, they look like they’re playing games (which they are). If it goes to the Senate, it will probably get overturned, and Trump will look innocent to his supporters, and it will strengthen their support…

/ Plus, Trump will have learned that he can get away with a lot. And he will take advantage of this, and try to get away with a lot more. Which will drive the left to more madness. I don’t think Dems plan on sending this to the Senate. Look-See:

/ If you are as sick of this as I am… we need to work hard to elect #PresidentTulsi. She’s the only one with the will and desire to #StopTheInsanity.
